Rep. Mike Kennedy, architect of Utah's transgender care ban, votes against federal crackdown
Utah Republican Rep. Mike Kennedy—architect of Utah’s ban on gender-affirming care for transgender minors—broke with most of his party on Wednesday, voting against Rep. Marjorie Taylor Greene’s bill that would expand the crackdown on such care nationwide.
On Wednesday, Kennedy opposed H.R. 3492, Greene’s “Protect Children’s Innocence Act,” which would criminalize gender-affirming medical care for anyone under 18—including surgeries and the prescribing of puberty blockers and hormones. Providers could face fines and up to 10 years in federal prison; in some cases, parents and others who facilitate care could face criminal liability.
He was one of four Republicans who voted against the measure.
Kennedy did not respond to a request for comment but posted a statement on his official congressional social media.
“I voted against H.R. 3492 because it expands federal powers in a way that will invite constitutional challenges and leave loopholes that will be exploited,” Kennedy’s statement read.
“I am opposed to the evil practice of transgender child mutilation and am committed to finding a solution, as I did in the State of Utah, to protect America’s children.”
In 2023, Kennedy sponsored SB16 in Utah, banning gender-affirming surgeries for transgender youth and placing a moratorium on hormone therapy for minors.
And on Thursday, he voted for H.R. 498, which would prohibit Medicaid funding for certain gender-transition care for minors—reinforcing his preference for restricting access via funding rather than a new federal criminal regime.
